Terms of Use
Departd gives you estimated departure and wake-up times from your calendar, traffic, and weather. These are helpful suggestions only — you’re responsible for your own time management, and we strongly recommend always setting a backup alarm for critical events.
1. Acceptance of terms
By downloading, installing, or using Departd ("the app"), you agree to be bound by these Terms of Use. If you do not agree, do not use the app.
2. Description of service
Departd is a scheduling-assistance app that calculates suggested wake-up times, departure times, and travel buffers from your calendar events, real-time traffic, weather, and your prep preferences. It monitors conditions overnight and during the day and may adjust its suggestions as conditions change.
3. Important disclaimers
Scheduling estimates only
All wake-up times, departure times, travel durations, weather buffers, and arrival predictions are estimates only and should not be relied upon as your sole means of time management for critical events. They depend on third-party data (traffic, weather, mapping) that may be inaccurate, delayed, or unavailable.
Always set a backup alarm
For time-critical events — flights, medical appointments, interviews, legal proceedings, important meetings — you should always set an independent backup alarm. Departd is designed to assist your time management, not replace your responsibility for punctuality.
No guarantee of notification delivery
Departd relies on the iOS notification and background-processing systems, which Apple manages. iOS may delay, throttle, or suppress notifications and background tasks based on system conditions, battery, and usage. We cannot guarantee alarms or alerts are delivered at the exact scheduled time, or at all.
4. Limitation of liability
To the maximum extent permitted by law, Christopher Radtke and Departd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Missed flights, trains, buses, or other transportation
- Late arrival at appointments, meetings, interviews, or events
- Financial losses from missed or late attendance at any event
- Employment consequences resulting from tardiness or absence
- Damages arising from inaccurate travel, weather, or traffic information
- Damages arising from failure of notifications to deliver on time
- Damages arising from iOS background-processing limitations
This limitation applies regardless of the legal theory, whether or not you were advised of the possibility of such damages, and whether or not a limited remedy fails of its essential purpose.
5. Assumption of risk
- Departd provides scheduling suggestions, not guarantees of on-time arrival
- Traffic, weather, and other variables change rapidly and unpredictably
- Third-party data sources may contain errors or be temporarily unavailable
- iOS limitations may affect background processing, notifications, and location monitoring
- You retain full responsibility for managing your time
- You will use Departd alongside — not as a replacement for — your own judgment
6. Subscription terms
Departd offers an optional paid Pro subscription with enhanced features, billed through Apple’s App Store and subject to Apple’s terms. You may cancel anytime in your Apple ID settings; refunds are handled by Apple. Free-tier features may change over time, though we will not remove core functionality from an active paid subscription during its current billing period.
7. Intellectual property
Departd, its design, features, and underlying technology are the intellectual property of Christopher Radtke. Certain aspects of the technology are the subject of a pending patent application with the United States Patent and Trademark Office. You may not reverse engineer, decompile, or disassemble the app, or attempt to derive its source code.
8. User conduct
- Do not use Departd while operating a vehicle (configure it before driving)
- Do not rely on Departd as your sole alarm for safety-critical or emergency situations
- Do not attempt to circumvent subscription restrictions or manipulate the app
- Do not use the app in any manner that violates applicable laws
9. Modifications
We may modify, update, or discontinue Departd or any feature at any time, and may update these Terms from time to time. Material changes will be communicated in-app or by updating the "Last Updated" date above. Continued use after changes constitutes acceptance.
10. Termination
You may stop using Departd and delete the app at any time. We reserve the right to suspend or terminate access if you violate these Terms.
11. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law provisions. Disputes are subject to the exclusive jurisdiction of the courts of Orange County, California.
12. Severability
If any provision is found unenforceable, it will be limited or eliminated to the minimum extent necessary so the remaining provisions stay in full force.
